The Law We Want to Change

If a Mortgage Assignment Is Forged, Shouldn't a Homeowner Be Allowed to Challenge It?

This page explains, in plain English, the legal framework the Young family encountered — and the reform they are proposing. It is a public education effort. Nothing here is enacted law unless cited as such, and the proposed reform is a policy principle, not legislation.

The Building Blocks

Mortgage

A legal instrument that pledges real property as security for a loan. It is recorded with the county and gives the lender an interest in the home that can be enforced through foreclosure if the loan is not repaid.

Promissory Note

The borrower's written promise to repay the loan — the debt itself. The note is separate from the mortgage: the note is the obligation to pay; the mortgage is the collateral that secures it.

Mortgage Assignment

A document transferring a lender's interest in a mortgage from one party to another. The validity of an assignment can matter because the party seeking to foreclose must generally be entitled to enforce the secured debt.

Foreclosure

The legal process by which a lender enforces the mortgage and causes the property to be sold to satisfy the debt. In North Dakota, foreclosure is a judicial process conducted through the courts.

The Problem: Standing to Challenge an Assignment

A central issue in the Young family's case concerns a borrower's ability to challenge the validity of a mortgage assignment — a document to which the borrower was not a party. Courts in some jurisdictions draw a distinction between assignments that are void (legally nonexistent, such as one forged or executed by someone without authority) and those that are merely voidable (valid until set aside by a party with standing).

The Young family contends that, when a homeowner presents credible evidence that an assignment may be forged or fraudulent, the homeowner should have a meaningful opportunity to put that evidence before a court before losing their home. They believe the legal framework they encountered did not allow that evidence to be fully considered on the merits.

This page does not assert that North Dakota law contains a blanket statutory prohibition on such challenges. The specific statutes, cases, and judicial interpretations involved are identified in the citation library below, drawn from verified sources. Where a characterization is disputed, it is marked as the family's position.

The Proposed Reform

"A North Dakota homeowner facing foreclosure should have a meaningful opportunity to challenge the validity or authenticity of a mortgage assignment when the homeowner presents credible evidence that the document may be forged, fraudulent, or legally void."

Draft Homeowner Protection Proposal

The following points outline a draft framework. This language remains in draft status until legally reviewed and finalized.

  • Standing to challenge potentially forged or void mortgage assignments when a homeowner presents credible evidence.
  • Clear evidentiary requirements for bringing such challenges, so that meritorious claims proceed and unsupported ones do not.
  • Meaningful judicial review of disputed assignments before a foreclosure judgment is entered.
  • Protection against abusive or unsupported challenges that delay legitimate enforcement without basis.
  • Preservation of the legitimate rights of lenders and assignees who hold valid, properly supported interests.
  • Appropriate remedies when a document is proven invalid, including dismissal or other relief warranted by the record.
  • Fair notice and procedural safeguards for all parties throughout the process.

Draft Legislative / Constitutional Language

Formal statutory or constitutional language is being developed and will be published here once it has been reviewed by qualified legal counsel. No draft language is presented as final or as introduced legislation.
